Terms of Service

These Terms of Service govern website design, build, delivery, hosting, maintenance, and related services provided by The Sitesmith. By purchasing a website build or maintenance package, you agree to these terms.

The Sitesmith builds custom websites for service-based businesses. Each project is based on the information, preferences, business details, and revision requests you provide.

Once you decide to move forward, The Sitesmith will send a secure Stripe payment link. Work, revisions, file delivery, hosted launch, and related service obligations begin after payment is received.

Stripe may send payment receipts or refund receipts directly to the email address used at checkout. Refund timing may depend on Stripe, your bank, or your card provider.

Your website build may include a custom homepage, mobile-responsive design, contact form or booking system setup, SEO optimization, a walkthrough call, one focused revision round, and finished website files or hosted launch support depending on the package selected.

The Sitesmith may use modern website frameworks, third-party hosting platforms, form tools, scheduling tools, analytics tools, payment processors, domain registrars, or other services needed to complete the project.

You are responsible for providing accurate business information, brand preferences, contact details, images, copy, account access, and any other materials needed to complete the site.

You confirm that you have the right to use any text, images, logos, trademarks, or other materials you provide. The Sitesmith is not responsible for claims related to materials supplied by you.

Your walkthrough call is used to review the site, understand your business needs, and align the final details with your goals. After payment is received, you will receive a revision form for your included revision round.

Your included revision round allows you to submit all requested changes in one organized request. Requests should be clear, specific, and within the original project scope.

The 24-hour delivery guarantee applies when your completed revision form is received within 4 hours of payment being made. When that condition is met, The Sitesmith will deliver your finished website files or launch your hosted site within 24 hours.

If The Sitesmith does not meet the guaranteed 24-hour delivery window, we will return your payment and still complete and deliver the website you requested.

The guarantee does not apply to delays caused by late or incomplete revision forms, missing client information, unavailable domain names, domain or DNS access issues, third-party platform outages, payment processing delays, requests outside the original project scope, or delays caused by the client.

Build-only clients receive finished website files for self-hosting. The Sitesmith also provides a step-by-step self-hosting guide for major hosting platforms.

Build-only clients are responsible for choosing a hosting provider, creating accounts, paying hosting or domain fees, uploading files, maintaining the website after delivery, and resolving issues with their selected hosting provider.

Clients who choose the hosting and maintenance package receive managed hosting from The Sitesmith, with a domain included as part of the service. The package requires the monthly fee and any stated commitment shown at checkout or in the project offer.

Domain inclusion is subject to availability, registrar rules, reasonable domain pricing, and client approval. Premium domains, brokered domains, or unusually expensive domains are not included unless agreed in writing.

If the maintenance package is canceled or not renewed, The Sitesmith may provide reasonable instructions for transferring the site or domain, but continued hosting and maintenance are not included after cancellation.

Requests that materially change the original project scope may require a separate quote, a new timeline, or an additional service agreement. Examples include additional pages, custom applications, complex integrations, brand identity work, advanced copywriting, ecommerce functionality, or large content migrations.

After full payment is received, you own the final website content and finished website files created specifically for your project, excluding third-party tools, open-source software, licensed assets, platform services, and pre-existing materials owned by The Sitesmith or others.

The Sitesmith may display completed work in its portfolio or marketing materials unless you request otherwise in writing.

Refunds are limited to the 24-hour delivery guarantee described in these terms unless otherwise agreed in writing. If the guarantee applies and The Sitesmith misses the delivery window, your payment will be returned and your requested website will still be completed and delivered.

To the fullest extent allowed by law, The Sitesmith is not liable for indirect, incidental, special, consequential, or lost-profit damages related to the website, hosting, third-party platforms, downtime, search ranking changes, business results, or client-provided materials.

No website can guarantee specific revenue, ranking, lead volume, conversion rate, or business outcome.

The Sitesmith may update these Terms of Service from time to time. The version posted on this page is the current version and applies to services purchased after the updated terms are published.
